can't call husband for dates :(

when I go to any place which allows dates, my husband (a real life friend) won't show in the list of options to call.
curiously, when I go on any professional appearance - including parties at my homes - he shows as an option to call, and when I select him I get a warning saying I won't get any credit for calling him because we are dating.
I've checked all of the date spots in the game and he isn't stuck or idle in any of those. he always shows up in my houses or his house in calabasas when I check... I just can't call him for dates.
any idea what gives? (might it be related to us being maxed out?)
