You don't necessarily have to file for a divorce but you can break up with them. Just go to a dating point and select your husband/wife. Click on their speech bubble and the option "break up" will be listed. Click that option and you will be single again

As SamuraiPizzaCat's guide, that's the most direct way to break up with your husband.
My indirect way of breaking up with your current spouse is to go on a date with another person (NPC or friend in game is both okay) then your husband will feel cheated, he will call you immediately (after your date with another person) and ask for a break-up.
