PVP Gear tier glitch

I'm noticing alot in pvp that the benefits for alot of moves that aren't unlocked until gear tier 5 and up are still being proced even though my opponents summons are not gear tier high enough to even unlock the additional ability upgrade. I've notice Sully being able to stun with Scary feet at gear 3,4 and its locked till gear 5. There are others that this is happening with as well. But its always my opponent characters doing it and not mine.

Yzma's "I'm Brilliant", skill that increases speed meter by 15% per villain or kingdom teammate is activating its secondary ability upgrade to damage an opponent with three harmful effects is procing at gear tier 4 as soon as the passive ability is unlocked even though its supposed to be locked till gear tier 6.
